Welcome to AVIKII™. These Terms of Service govern your use of this website and any purchases made from AVIKII™.

By accessing this website or placing an order, you agree to these Terms of Service and all applicable laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”).

2. General Use

By using this website, you confirm that:

  • you are legally capable of entering into binding agreements;
  • you are legally permitted to purchase and possess firearm-related accessories in your jurisdiction;
  • all information provided by you is accurate and complete.

AVIKII™ reserves the right to refuse service or cancel orders where permitted by law.

Nothing in these Terms limits any rights afforded to consumers under the Consumer Protection Act.

3. Product Information

AVIKII™ makes every reasonable effort to ensure that product descriptions, specifications, dimensions, photographs, pricing, and availability are accurate.

However:

  • minor manufacturing variations may occur;
  • colours and finishes may vary slightly;
  • product images are for illustrative purposes and may include optional accessories.

Any obvious pricing or typographical errors may be corrected before order fulfilment, provided the customer is informed.

4. Orders & Acceptance

Placing an order does not automatically constitute acceptance of the order.

An order is deemed accepted only once payment has been confirmed and the order has been formally processed by AVIKII™.

AVIKII™ reserves the right to decline or cancel orders where:

  • products are unavailable;
  • incorrect pricing occurred;
  • fraud or unlawful activity is suspected;
  • the transaction would violate applicable laws.

Where payment has already been made for a cancelled order, a refund will be processed within a reasonable period.

5. Lead Times

Unless otherwise stated, products are manufactured and/or assembled to order.

Estimated lead time:
Approximately 4 weeks from confirmed payment and order confirmation to dispatch/delivery.

Lead times are estimates only and may vary due to:

  • production scheduling;
  • supplier delays;
  • coating/finishing delays;
  • courier or logistics disruptions;
  • circumstances beyond reasonable control.

AVIKII™ will make reasonable efforts to keep customers informed of material delays.

6. Barrel Threading & Compatibility

AVIKII™ does not perform barrel threading services.

Where a firearm barrel is not already threaded:

  • the customer must consult a qualified gunsmith;
  • AVIKII™ may provide referrals where possible, but accepts no responsibility for third-party workmanship.

Where threading already exists:

  • the customer must provide accurate thread measurements and/or barrel specifications;
  • compatibility remains the responsibility of the purchaser.

Improper installation or incompatible threading may result in damage or unsafe operation.

7. Pricing & Payment

All prices are displayed in South African Rand (ZAR).

AVIKII™ is currently not registered as a VAT vendor unless expressly stated otherwise.

Payment must be received in full before manufacturing or dispatch.

Accepted payment methods may change from time to time.

8. Shipping & Delivery

Delivery times are estimates only and not guaranteed.

Risk in the goods passes to the customer upon delivery to the nominated address or collection by the courier.

Customers must inspect goods upon receipt and notify AVIKII™ within a reasonable period of any apparent damage or defects.

9. Returns, Refunds & CPA Rights

Nothing in these Terms excludes any rights afforded under the Consumer Protection Act.

Customers may be entitled to returns, repairs, replacements, or refunds in circumstances provided for under the CPA.

The following conditions apply:

9.1 Defective Products

If a product is defective, unsafe, or materially inconsistent with its description, the customer may be entitled to remedies under section 56 of the CPA.

9.2 Custom or Special Orders

Custom-made, specially coated, specially threaded, modified, or made-to-order products may not qualify for cancellation or return once production has commenced, except where required by law.

9.3 Incorrect Use

Warranty and return rights do not apply where damage results from:

  • misuse;
  • negligent handling;
  • unauthorized modification;
  • improper installation;
  • incompatible firearm platforms;
  • excessive heat or misuse;
  • unlawful use.

10. Limitation of Liability

Nothing in these Terms seeks to exclude liability where exclusion is prohibited by South African law.

Subject to applicable law, AVIKII™ shall not be liable for:

  • indirect or consequential losses;
  • loss of profits;
  • damages arising from improper installation or misuse;
  • unlawful possession or unlawful use of products.

Products must always be installed and used safely and responsibly.

11. Intellectual Property

All trademarks, branding, logos, product names, images, text, and website content remain the property of AVIKII™ and/or AVIKII (Pty) Ltd unless otherwise stated.

No content may be copied, reproduced, or distributed without prior written consent.

12. Privacy

Any personal information collected through this website will be processed in accordance with applicable South African privacy laws, including the Protection of Personal Information Act (“POPIA”).

Customer information will not be sold or unlawfully disclosed.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms or use of the website shall be subject to the jurisdiction of the South African courts.

14. Amendments

AVIKII™ reserves the right to amend these Terms of Service from time to time.

Updated terms will become effective upon publication on the website.
